Why we have a waiver

Hiking with dogs is an amazing experience, but it also involves inherent risks like off-leash activity, uneven terrain, wildlife, and interactions with other dogs. Our waiver outlines these risks and includes important information about your responsibilities as a dog owner.

Keeps everyone safe

Helps us provide the best possible care and be prepared for unexpected situations.

Clear expectations

Makes sure we’re all on the same page before hitting the trails.

Peace of mind

Allos us to focus on what we love most: happy, healthy dogs.

1. Dog Suitability, Temperament, and Owner Representations

Client represents and warrants to Operator that the dog(s) enrolled in the Services (each, a “Dog”):

  • Has reliable voice and/or whistle recall and will return to the handler or guide on command, including around other dogs, wildlife, and distractions typical of trail environments;
  • Has no documented or known history of aggression, biting, snapping, lunging, resource guarding, or attacking toward people, dogs, or other animals;
  • Is comfortable and well-socialized in group settings with unfamiliar dogs and people;
  • Is in good general health, free of any contagious illness, parasite infestation, or condition that could pose a risk to itself, other dogs, or staff during the Services;
  • Is current on core vaccinations (including rabies) as recommended by a licensed veterinarian, and is current on flea/tick and parasite prevention appropriate for trail activity;
  • Is wearing a properly fitted collar or harness and identification tags suitable for off-leash and on-leash activity; and
  • Has no behavioural, medical, or physical limitation that Client has not separately disclosed in writing to Operator prior to the Services.

Client acknowledges that Operator relies entirely on the accuracy of these representations in assessing whether the Dog is suitable for group hiking. Client agrees to immediately and proactively disclose, in writing, any change in the Dog’s temperament, health, recall reliability, or behaviour — including any incident occurring outside of Operator’s care — prior to any further Services.

Operator reserves the right, in its sole discretion, to refuse, suspend, or remove any Dog from the Services at any time, before or during a hike, if Operator reasonably believes the Dog poses a risk to itself, other animals, staff, or the public, with no refund obligation for sessions affected by such removal.

2. Assumption of Risk

Client understands and acknowledges that dog hiking and related activities carry inherent and significant risks that cannot be eliminated regardless of the care taken by Operator, including but not limited to:

  • Uneven, slippery, steep, icy, muddy, or otherwise hazardous terrain; falling rocks, trees, or branches;
  • Encounters with wildlife (including bears, cougars, coyotes, snakes, and other animals) and their associated risks;
  • Interactions, scuffles, or fights between dogs, including dogs not enrolled in the Services;
  • Adverse or sudden changes in weather conditions;
  • Off-leash activity, including the risk that a Dog may fail to recall, become lost, run onto a roadway, or be injured despite reasonable supervision;
  • Transportation of the Dog in a vehicle to and from trailheads;
  • Insect bites or stings, exposure to toxic plants or substances, and waterborne or trail-borne illness or parasites; and
  • Physical exertion-related injury or medical events, including those related to pre-existing conditions not disclosed to Operator.

Client voluntarily and knowingly assumes all such risks, known and unknown, and accepts sole responsibility for any injury, illness, death, loss, or damage to the Dog, to Client, or to any third party arising from or connected to the Services, except to the extent caused by the gross negligence or wilful misconduct of Operator.

3. Release and Waiver of Liability

To the fullest extent permitted by law, Client, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, discharges, and covenants not to sue Operator, and its owners, directors, employees, contractors, and agents (collectively, the “Released Parties”), from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, illness, or death that may occur during, or as a result of, the Services — whether caused by the negligence of the Released Parties or otherwise — except for liability that cannot be excluded by law, including liability for gross negligence or wilful misconduct.

This release is intended to be as broad and inclusive as permitted under the laws of the Province of British Columbia, and Client confirms that, if any portion of this release is held invalid, the remainder shall continue in full force and effect.

4. Indemnification

Client agrees to indemnify and hold harmless the Released Parties from and against any and all claims, demands, losses, damages, costs, and expenses (including reasonable legal fees) arising from or related to: (a) any act or behaviour of the Dog, including bites, attacks, property damage, or injury caused by the Dog to any person, animal, or property; (b) any breach of Client’s representations in Section 1; and (c) any failure by Client to disclose relevant information about the Dog’s health, temperament, or behaviour.

5. Acknowledgment of Occupiers Liability Act (British Columbia)

Client acknowledges that the Services may take place on trails, parks, and lands that are owned, managed, or maintained by third parties (including municipal, provincial, or private landowners), and that such premises are used at Client’s and the Dog’s own risk. This Agreement is intended to constitute notice for the purposes of the Occupiers Liability Act, R.S.B.C. 1996, c. 337, that Operator and any applicable occupier assume no greater duty of care than otherwise permitted by law, and that any warning of risk required under that Act is provided generally by this Agreement. Nothing in this Agreement relieves any party of a duty of care that cannot be excluded by law.

6. Photography and Media Consent

Client consents to Operator photographing or filming the Dog during the Services and using such images or video for reasonable business, promotional, or social media purposes, without compensation to Client, unless Client opts out in writing prior to the session.

7. Payment, Cancellation, and Conduct

Client agrees to comply with Operator’s scheduling, cancellation, and payment policies as communicated separately by Operator. Operator reserves the right to terminate this Agreement and decline future Services at its sole discretion, including where Client provides inaccurate information about the Dog or fails to comply with reasonable safety instructions.

8. Emergency Veterinary Care Authorization

In the event the Dog becomes injured or ill during the Services and Client cannot be reached in a timely manner, Client authorizes Operator to secure emergency veterinary treatment as Operator reasonably deems necessary. Client agrees to be solely responsible for all costs of such treatment and to reimburse Operator for any amounts advanced on Client’s behalf.

9. Governing Law and Severability

This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

10. Entire Agreement

This Agreement constitutes the entire agreement between Client and Operator regarding its subject matter and supersedes any prior oral or written understandings. This Agreement remains in effect for all future Services provided to Client and the Dog(s) named below unless revoked in writing by either party.
